The NDIA has announced some rule changes that could impact access to supports and how participants navigate the NDIS. These updates are part of the 2024 NDIS Amendment Bill, aimed at giving more clarity on funds and the supports that can be claimed.

Here’s what will change from Thursday, October 3, and over time:

NDIS Supports Definition
A new definition clarifies what you can and can’t spend your funds on. From October 3, 2024, items on the “not approved” list will be rejected. For more information on these lists, visit NDIS website here

Stricter Compliance
The NDIA will have more authority to adjust plans and monitor spending to ensure funds are used as intended. This could include changing plan amounts or periods if spending is inconsistent with your plan. This applies to participants who self-manage or use a registered plan manager.

Changes to NDIS Plans
NDIS plans are getting a new format. While details are limited, all new plans from October 3 will last up to 12 months, with spending capped by your plan. Transitioning to the new framework may take five years or more, and you’ll be notified when it’s time for you to switch.

Stronger Evidence for Change of Circumstance
From October, stronger evidence will be required to request a change in circumstance. Reassessment will only happen if criteria, like crisis or health threats, are met.

Support Needs Assessment
A new assessment will replace medical diagnoses to determine funding needs, aiming to simplify how you provide evidence of your disability and offer more flexible funding options.

Early Intervention Pathway
NDIA will assess your eligibility under two pathways—disability or early intervention. If approved, you’ll receive support based on your eligibility pathway.

What’s Next?
With the legislation now passed, the Australian Government is working with the disability community to finalize NDIS Rules. Updates based on community feedback on the draft support list will be shared soon.
